18 June 2014: The Minister of the Economy, Production Renewal and the Digital Economy has sought the opinion of the Autorité de la concurrence on certain regulated professions

Arnaud Montebourg, the Minister of the Economy, Production Renewal and the Digital Economy has just sought the opinion of the Autorité de la concurrence on various competition questions arising from the fixing and review of rates in certain legal professions.

The professions concerned are as follows:

  • public and ministerial officials (officiers publics et ministériels, OPM), namely the auctioneers (commissaires-priseurs judiciaires),the commercial court clerks, the court bailiffs and notaries;
  • courtappointed receivers (administrateurs judiciaires);
  • courtappointed agents(mandataires judiciaires).

The Autorité will examine two questions in particular:

1 - Where does the dividing line lie between activities that are public service matters and those that respond to an economic logic?

2 - What objectives and what method should be used in fixing and reviewing rates within these professions?
