Leniency

The Autorité de la concurrence may grant total or partial exemption from financial penalties to an undertaking or an association of undertakings which has, with others, implemented an anticompetitive agreement between competitors within the meaning of Article L. 420-1 of the French commercial code.

To this end, the undertaking or association of undertakings must contribute to establishing the reality of the prohibited practice and to identifying the participants therein, by providing all relevant information.

Information on the existence of any other leniency applications

Yes, the leniency applicant wishes to benefit from a period of time during which their place in the queue for leniency will be guaranteed before the Autorité de la concurrence ("marker period") in accordance with Article R.464-5-3 of the French commercial code.

Important - In the absence of a request for a marker period, the leniency application will be dated the day and time at which all the elements supporting the statements will have been submitted to the Autorité de la concurrence (and not the day and time of this application).
