The Autorité appoints consultancy firm CompetitionRx as independent trustee
responsible to monitor Altice-Numericable’s commitments undertaken to take over SFR

>Version française

The Autorité has appointed today the consultancy firm CompetitionRx as monitoring trustee to check Numericable’s compliance with the commitments undertaken in order to clear its takeover of SFR (decision 14-DCC-160 of 30 October 2014).

The commitments contain both structural (divestures) and behavioural measures (commitments relating to the new group's behaviour).

CompetitionRx has already carried out the functions of independent trustee for the European Commission in numerous cases, including merger matters in the telecoms sector. CompetitionRx is a consultancy firm specialized in the field of competition law compliance.

Numericable also committed not to share strategic information concerning Altice with Vivendi, which retains a 20% share in the new group.

These measures will be monitored by an "independent third party". The appointment of the latter, which must also be approved by the Autorité, hasn’t yet been the subject of any decision.
