Aux termes de la décision ci-après, l’Autorité de la concurrence considère que le grief d’abus de position dominante notifié à l’encontre de la société TDF sur le fondement des articles 102 du TFUE et L. 420-2 du code de commerce n’est pas établi.

Dans cette affaire, l’Autorité a été saisie par la société towerCast, qui estimait que la prise de contrôle de la société Itas par la société TDF, le 13 octobre 2016, constituait un abus de position dominante, contraire aux dispositions de l’article L. 420-2 du code de commerce.

Aux termes de la décision ci-après, l’Autorité a procédé à l’examen de la création, par les groupes France Télévisions (FTV), TF1 et Métropole Télévision (M6), d’une entreprise commune de plein exercice dénommée Salto qui aura pour activité, dans le cadre d’offres payantes, d’une part, la distribution de services de télévision et de médias audiovisuels à la demande et, d’autre part, l’édition d’une offre de vidéo à la demande par abonnement. Ces offres seront diffusées sur l’Internet ouvert (en diffusion « over the top » ou OTT).
