Erwann Kerguelen appointed Deputy General Rapporteur of the Autorité de la concurrence

Erwann Kerguelen

Erwann Kerguelen has been appointed Deputy General Rapporteur of the Autorité de la concurrence by the General Rapporteur, Stanislas Martin, who heads the Investigation Services of the Autorité.

As of 15 July 2021, he will head Antitrust Unit 3, whose responsibilities include cases involving the distribution sector. He will take over from Joël Tozzi, who, at the end of his two mandates, has been appointed Head of Unit 6A "Energy and Environment" at the General Directorate for Competition, Consumer Affairs and Fraud Control (DGCCRF).

Biography

Erwann Kerguelen is a food engineer with a Certificate of Aptitude in Business Administration (CAAE) and a Master's degree in Competition and Contract Law. He joined the Île-de-France Regional Directorate for the Economy, Employment, Labour and Solidarity (DIRECTTE) in 2008 as Carrefour's national coordinator in charge of implementing the framework for protection against unfair trade practices.

Rapporteur at the Autorité de la concurrence since 2011, and appointed expert in 2017, he has notably worked on the investigation of cases relating to the Auchan/Casino/Metro/Shiever (20-D-13) and Carrefour/Tesco (20-D-22) joint purchasing agreements and participated in the investigation of the decisions sanctioning the floor coverings cartel (17-D-20) and the white goods cartel (18-D-24) He was also involved in investigating the opinion on the assessment of the impact of increasing the threshold of ban of below-cost selling (18-A-14).

He is the author of several editions of a book, Les pratiques restrictives - l'application de l'article L. 442-6 du code de commerce à travers la jurisprudence, Revue Concurrence, and also regularly writes articles for various specialised journals.
