Fibre broadband rollout in Mayotte: the Autorité de la concurrence orders interim measures against Orange

Following complaints filed by Réunicable and its subsidiary Mayotte THD, as well as by the département-region of Mayotte, regarding Orange’s practices in the rollout of Fibre-to-the-Home (FttH) in Mayotte, the Autorité has imposed interim measures.

The complainants criticised Orange’s decision to unilaterally roll out a FttH network from March 2025 in five of Mayotte’s 17 municipalities, even though, in January 2025, the département-region had granted Mayotte THD a public service delegation (PSD) to roll out an FttH network throughout Mayotte.

The Autorité considered that Orange’s conduct was likely to constitute an abuse of a dominant position and cause serious and immediate harm to the sector concerned and the interests of the complainants and consumers in Mayotte.

Orange’s decision, which was imposed on the complainants, is likely to result in a significant loss of revenue for Mayotte THD, jeopardising the financial stability of the PSD and public funding for the network.

This situation threatens to deprive consumers in the least densely populated areas of Mayotte of access to FttH services for an extended period and risks exposing them to an uncoordinated rollout of ultra-high-speed broadband infrastructure.

The Autorité therefore orders Orange to:

  • suspend the rollout of its fibre network in Mayotte, as well as any commercial canvassing of operators in the wholesale market for access to the fibre local loop in areas where the network has not yet been rolled out. At Orange’s request, this injunction be lifted or revised in the event of abnormal delays to the public initiative network (PIN), the conclusion of a co-rollout agreement covering the whole of Mayotte, or an adjustment to the PSD to incorporate Orange’s existing rollouts, together, where appropriate, with an adjustment to the public funding arrangements for the project;
  • provide the French electronic communication, post and print media distribution regulator (Autorité de régulation des communications électroniques, des postes et de la distribution de la presse – ARCEP) and the département-region with an overview of Orange’s fibre rollout in Mayotte to date, as well as a report on the condition of the copper network and infrastructure; and
  • guarantee the concession holder access, as and when required, to the broadband and ultra-high-speed broadband civil engineering infrastructure under Orange’s control in Mayotte, for the purposes of rolling out the PIN project.
