En application du I et du II de l’article L. 430-8 du code de commerce, l’Autorité de la concurrence a sanctionné la société Compagnie Financière Européenne de Prises de Participation (ci-après « COFEPP ») à hauteur de 7 millions d’euros pour la réalisation sans notification et la réalisation avant autorisation d’une opération de concentration dans le secteur des spiritueux. L’opération de prise de contrôle de la société Marie Brizard Wine & Spirits (ci-après MBWS) par COFEPP avait été notifiée en 2019, postérieurement à sa réalisation.
