The debate was lively, in France and in Europe on the need to strengthen merger control to better understand certain transactions "below the thresholds", in particular in the digital field.

As a result of these discussions, the Commission announced at the end of 2020 that it would now agree to examine "below-threshold" mergers, within the framework of Article 22 of the 2004 Regulation, thereby modifying its previous doctrine. This is an important development for businesses.

During a discussion moderated by Etienne Chantrel, Head of the Merger Unit, Olivier Guersent discussed the Commission's new approach to referrals made under Article 22 of Regulation 139/2004 on merger control.
