As part of a contentious procedure opened before the Conseil de la concurrence, France Télécom offers commitments
The Conseil de la concurrence publishes these commitment proposals on its internet website so that third parties can give their observations
On the basis of Article L. 464-2, section I of the Code of commercial law, following Ordinance n°2004-1173 of 4 November 2004, The Conseil de la concurrence has the power “to accept commitments offered by companies or bodies likely to put an end to anticompetitive practices”, according to Article R. 464-2 of the code of commercial law.
Background
In the case n°07-MC-03 of 7 June 2007, the Conseil de la concurrence had to hear about practices implemented by France Télécom on the market of engineering, consultancy and technical check of telephone installations made in the private sector, designed to evict one of its competitors on the market where it wished to settle.
The services proposed on the market consist in validating the telephone installation plan achieved in the private sector, and in guaranteeing the follow-up of works and the check of standards through the delivery of a receipt statement, also called certificate of compliance or compliance receipt. France Télécom services need this compliance certificate as well as a conveyance point so as to meet the connection requests to the telephone network.
In Decision n°07-MC-03 aforementioned, The Conseil de la concurrence pronounced several injunctions against France Télécom.
First, the Conseil de la concurrence ordered France Télécom to put an end to any denigration practice against the company who submitted the referral and to guarantee by all means the respect of the injunction by its local network divisions.
The Conseil also ordered France Telecom to postpone the implementation of the price of the service called “provision of PR with movement” in its “service collection – property sector”, until the Conseil reaches a decision on the merits.
Lastly, the Conseil de la concurrence ordered France Télécom to meet the communication requests for the conveyance point enabling the connection only within 15 days after the transmission by the company of the situation map, the site plan and a short outline of the expected operations, to connect the residents to the network opened to the public within 8 calendar days from the date of the connection request as soon as the works checking plan along with their compliance certificates would be received, to put an end to any practice consisting in ordering the payment of already provided services by others and to ensure by all means that this injunction is respected by its local network divisions.
The commitments proposed by France Télécom
With the aim to perpetuate the adopted measures to conform to the injunctions pronounced by the Conseil de la concurrence, France Télécom offers to provide a service for the supply of the conveyance point localization to the telephone network. This service offers two possible methods: with or without moving France Télécom staff and inscribing this service in its property sector service collection. This proposal also applies to companies' requests concerning the segment of detached houses.
France Télécom also offers to set up a single office designed to meet the requests for the supply of the conveyance point localization to the telephone network and to transfer any claim concerning contentious behaviours from France Télécom property consultants.
France Télécom offers at last to carry out cable studies and cable laying within a maximum of a 28 working day period from the receipt of the information needed and to connect the final user to the telephone network within 8 calendar days from the date of the request to the incumbent operator's services, except exceptional cases notably requiring specific works.
Pursuant to provisions of Article R. 464-2 of the Code of commercial law, the commitment proposals are published by the Conseil so that third parties can submit their observations if they wish to do so.
These observations, which will be added to the file, have to be sent by mail before 30 June 2008, 5:pm to the Conseil de la concurrence Procedural Service :
